Insurance Requirements for Kentucky Food Trucks

Operating a food truck in Kentucky requires several types of insurance coverage. Some are mandated by state law, while others are strongly recommended to protect your business from financial risk. Understanding these requirements before you launch will help you budget accurately and avoid legal complications.

Commercial Auto Insurance

Kentucky requires all motor vehicles, including food trucks, to carry minimum auto liability insurance. The state's minimum coverage requirements follow a 25/50/25 structure:

  • $25,000 bodily injury liability per person
  • $50,000 bodily injury liability per accident
  • $25,000 property damage liability per accident

Because food trucks are commercial vehicles with specialized equipment, standard personal auto insurance will not provide adequate coverage. Most food truck operators carry coverage well above the state minimums.

General Liability Insurance

General liability insurance protects your business against claims of bodily injury, property damage, and personal injury that occur during your operations. If a customer slips near your truck, suffers a burn, or experiences foodborne illness, general liability coverage helps pay for legal defense and any resulting settlements or judgments. Most event organizers, commissary kitchens, and municipalities in Kentucky require food trucks to carry at least $1,000,000 in general liability coverage per occurrence.

Workers' Compensation Insurance

Kentucky law requires most employers to carry workers' compensation insurance. If you have employees working on your food truck, you are generally required to maintain a workers' comp policy. There are exemptions for sole proprietors and certain small businesses, but the rules are specific. The Kentucky Department of Workers' Claims oversees compliance. Product Liability Insurance

Commercial Property and Equipment Insurance

Your food truck and its contents represent a significant investment. Commercial property insurance or inland marine insurance covers your cooking equipment, refrigeration, point-of-sale systems, and inventory against theft, fire, vandalism, and other covered perils. If your truck is damaged in an accident, this coverage helps pay for repairs or replacement of the specialized equipment inside.

Additional Coverage to Consider

  • Business Interruption Insurance: Covers lost income if your truck is out of service due to a covered event such as an accident or fire.
  • Umbrella Policy: Provides additional liability coverage above the limits of your auto and general liability policies.
  • Cyber Liability: If you process credit card payments, this covers data breach-related costs.
